Isles Trilogy Open Licence

 

Summary of Licence

The Isles Trilogy Open Licence allows for the creation and distribution of unofficial supplementary content based on the Isles trilogy of games under certain terms and conditions. In summary, you must:

1. Include the following text in your work: - INSPIRISLES (OVERISLES/UNDERISLES) is Copyright © Hatchlings Games Ltd. The use of the Isles Trilogy to develop derivative works is covered by the conditions of the Isles Trilogy Open License. Hatchlings Games Ltd accepts no liability or responsibility for any derivative works as per Section 5 of the Isles Trilogy Open License.

Two major conditions for qualifying for this Open Licence are that you must not:

1. Reproduce or alter the content of the Isles Trilogy, including INSPIRISLES, OVERISLES and UNDERISLES.

2. Use the Hatchlings Games Ltd logo.​

Licence in Full

For use of the Isles Trilogy intellectual properties to create and publish content independent of copyright holders (Hatchlings Games Ltd).

This Licence Agreement (“Open Licence”) is made effective as of the 25th of February 2022 by and between Hatchlings Games Ltd, a company organized and existing in England (“Licensor”) and any independent content creator who wishes to produce unofficial content for the Isles Trilogy (“INSPIRISLES/OVERISLES/UNDERISLES”). This License Agreement governs the copying, modifying and distribution of the Isles Trilogy.

1. Important Definitions

1.1. “Distribute” and “Distributing” mean to make available to the public, by any media and in any form, whether for free or for a fee.

1.2. “Isles Trilogy” refers to the rulesets, mechanics, images and writings found in INSPIRISLES, OVERISLES and UNDERISLES as well as any affiliated material published by the Licensor such as the Shapes of Adventure anthology and Belief Beasts & Disbelief Denizens.

1.3. “Official Content” refers to any supplementary content released by the Licensor through their website, including written material, images, videos and storefront products.

1.4. “Derivative Works” means any supplementary, unofficial material subject to Copyright that uses, is derived from or is based upon the Isles Trilogy of tabletop roleplaying games. This includes any translations or alterations to published material requiring permission under the Copyright held by the Licensor.

1.5. “Content Creator(s)” refers to any individual exercising the Licensed Rights under this Open License to create and Distribute their own Derivative Works.

1.6. “Licensed Rights” means those rights granted to Content Creators subject to the terms and conditions of this Open License.

2. Agreement

2.1. By exercising the Licensed Rights defined in Section 3, Content Creators accept and agree to the terms and conditions of this Open Licence. Content Creators are granted the Licensed Rights under acceptance of these terms and conditions.

 

3. Licenced Rights

3.1. Subject to the exceptions and limitations of this Open License as defined in Section 3.2. Content Creators must fulfil conditions stated in Section 4 for the Licensor to grant Content Creators permission to produce and Distribute Derivative Works and make full use of any Official Content as part of their Derivative Works.

3.2. Exceptions and Limitations:

a. This Open Licence does not grant Content Creators permission to redistribute or reproduce any substantial part of the Isles Trilogy source material.
b. This Open Licence is non-exclusive.
c. You may not sublicence under this Open Licence.
d. Moral rights, such as the right of integrity, are not Licenced under this Public License, nor are publicity, privacy, and/or other similar personality rights.
e. Patents and trademarks are not Licenced under this Open License.
f. Derivative Works may not contain or otherwise utilise the Licensor’s logo.
g. Where possible, the Licensor waives any right to collect royalties from Creators for exercising the Licensed Rights. This includes direct royalties or through collection via a statutory or compulsory licensing scheme. In all other cases the Licensor expressly reserves any right to collect such royalties.
 

4. License Conditions

4.1. Content Creators exercising the Licensed Rights are expressly made subject to the following conditions:

Content Creators must:

a. Make all reasonable efforts to obtain the information required for compliance with section 4.1(b)

b. Retain or include the following:

i. identification of the Isles Trilogy creators and any others designated to receive attribution, in any reasonable manner requested by the Licensor (including by pseudonym if designated);
ii. the copyright notice;

iii. a notice that refers to this Open License;

iv. a notice that refers to the disclaimer of warranties; and

v. reference to where the Isles Trilogy rulesets can be obtained.

c. Clearly indicate any modifications made to the Isles Trilogy rulesets and retain an indication of any such alterations;

d. indicate the Isles Trilogy is licensed under this Open License.

4.2. The obligations contained in section 4.1 should be fulfilled in a reasonable manner based on the medium, means, and context in which the Derivative Works are produced and Distributed.

4.3. If requested by the Licensor, Content Creators must remove any of the information required by Section 4.1(a) in a  reasonable and timely manner.

5. Liability Disclaimer

5.1. The Licensor does not accept any liability or responsibility for Derivative Works made in accordance with this Open Licence. This Open Licence does not affect the legal rights of the Licensor except those explicitly held within this Open Licence.

 

6. Term and Termination

6.1. This Open License applies for the duration of the term of Copyright licensed here. However, if any Content Creators fail to comply with this Open Licence, then their individual rights as a Content Creator under this Open License are automatically revoked.

6.2. If a Content Creator has Distributed Derivative Works which have failed to comply with this Open Licence, they must:

a. Make alterations to any Derivative Work(s) to ensure it complies with the Conditions of this Open Licence; or

b. Remove the Derivative Work(s) from Distribution and, if possible, inform customers why they have been removed.

6.3. Where a Content Creator’s Licensed Rights to use the Isles Trilogy as per this Open License have terminated under Section 6.1, it reinstates:

a. automatically on the date the violation is cured, provided it is cured within 30 days of the Creator’s discovery of the violation; or

b. upon express reinstatement by the Licensor. For the avoidance of doubt, Section 6.2 does not affect any right the Licensor may have to seek remedies for a Creator’s violations of this Open License.

c. The Licensor reserves the right to offer the Isles Trilogy under separate terms or conditions to this contract, or to stop distributing content at any time. Doing so will not automatically terminate this Open Licence.

7. Further terms and conditions

7.1. The terms applied under this contract may not be modified except by express written agreement between the Licensor and a specific, named Content Creator. The Licensor shall not be bound by any additional or different terms or conditions communicated by Content Creators unless expressly agreed.

7.2. Any arrangements, understandings, or agreements regarding the Isles Trilogy not stated herein are separate from and independent of the terms and conditions of this Open License.

7.3. Nothing in this Open License constitutes or may be construed as permission to assert or imply that Content Creators or their use of the Isles Trilogy is connected with, sponsored, endorsed, or granted official status by the Licensor or others designated to receive attribution as provided in Section 4.1(i).

 

8. Interpretation

8.1. For the avoidance of doubt, this Open License does not, and shall not be interpreted to reduce, limit, restrict, or impose conditions on any use of the Isles Trilogy that could lawfully be made without permission under this Open License.

8.2. Where possible, if any provision of this Open License is deemed unenforceable, it shall be automatically reformed to the minimum extent necessary to make it enforceable. If the provision cannot be reformed, it shall be severed from this Open License without affecting the enforceability of the remaining terms and conditions.

8.4 Nothing in this Open License constitutes or may be interpreted as a limitation upon, or waiver of, any privileges and immunities that apply to the Licensor or Content Creators, including from the legal processes of any jurisdiction or authority.
